Legal Question in Criminal Law in India
My Brother got married last year on 27 April, 2009. Infact it was love cum arrange marriage.
After the marraige for a few month they lived in joint family along with his father, mother, younger brother & un married sister
Since June - 2010 my brother in law & her wife were living sepretaly near by his parent's home. In Sept. - 2010 my brother again planed to live jointly with his parents as he came to know that his wife is pregnant & need the support of lady in such matter. While her wife was not agreed & escaped from the home ( where they were living sepretaly ) without giving any informaton to her husband & reached to her parents home who lives in Agra Distt. She also brought many of the things like � cash, her jewellary, small house hold thigs with her in the absence of her husband.
Now they ( Girl & her parents ) filed a case under sections 498 � A, 323, 405, 504 IPC. In this they charged all the family including her husband, father in law, mother in law, brother in law & sister in law.
They also charged me & my husband under these section. Is it possible to frame charges against us under the section 498 A.
I would like to bring in your kind information I lives in delhi ( Rohini ) with my husband & inlaws while my parents are living in Shahdara ( Delhi ).
I would also like to inform you that after being this matter ( after 7 - 10 days my brother's escaped from home where she was living with her husband only ) my father legally declared that there is no relationship is between my brother & rest of the family & he is not responsible what my brother will do in future. For that he has gave the add in print media.
Kindly suggest can they ( girl & her family member ) frame charges against also under these section.

even if they do, u have the remedy of filing anticipatory bail and getting protected
