Legal Question in Criminal Law in India
when does a case gets dismissed?
Hello there,
I was charged under section 420, IT ACT 66. On jan 2006 and was bailed out. There was a preliminary chargesheet which has been sent to the court within 6 months of the case registration but no other chargesheet has followed since then. I just want to know when will the case be on trial and can i put a petition for the trial to be started or when will this case be dismissed? is there any time period of submission of charge sheet.

You can file a petition before High Court to speed up the trial or permanent exemption from appearing in the court.

There is no time limit stipulated for the purpose.

Case appears to be a warrant trial. Can not be dismissed.
An accused can always pray for expeditious hearing and disposal of case.
There is nothing like preliminary charge sheet and final charge sheet.

Once the chargesheet is filed the court will frame issues and trial will commence. You can file a petition before Hon'ble Court speedy disposal of the case on day to day bases.
