First of all you have to file criminal complaint in police and if police did not register any complaint of harassment only then you can approach high court to file writ and to stay in retrenchment.

A Writ Petition is maintainable only when there is no alternate remedy.

One may file Writ Petition in a High Court under Article 226 or 227 and the Supreme Court under Article 32

yes, you need to inform the police first and in case their is inaction on their behalf, you may either file a complaint to the magistrate or approach the high court straightaway.
