Legal Question in Criminal Law in India

I caught the theif who has stolem my mobile and called 100, and report was fiired, now police is asking me to appear before the court. I dont want to appear before court. Will I got any punishment form the court if I will not appear before court. I donot want to continue the case.. I Want to withdraw from the case.. Can u plase suggest any procedure to do that..., Can I give any written application for court so that the case can be closed.. just appearing once in the case
