Legal Question in Criminal Law in India
The CBI registered a Case against me when I was in Service under a Cenral Autonomous Body. They filed a charge sheet after four months of my retirement without obtaining sanction from my department. Can I file an application for Discharge for non -obtaining of sanction from my appointing authority?

after retirement, you are not an employee. In any event now the sanction is not required.

if the offence is registered during when you are in service you will be protected under section 197 of cr.p.c.,hence, you can file discharge application
