You may take criminal as well as civil action. A criminal complaint is maintainable u/s 138 of Negotiable Instruments Act. A civil suit for recovery may also be filed. Both the proceedings run independent of each other.

u may initiate the criminal proceedings u/s 138 of negotiable instruments act and at the same time you may file a civil suit for recovery u/o 37 of civil procedure code
