Cheque bounce for the amount 4,0,5500

Complainant produced cheque on 27.3.2006 which is of firm account which closed on 14.8.2001 and I was one of the partner .How ever I didn't issue the cheque and haven't taken the loan from the complainant.Complaint's son who is looking after the firm misused the the cheque saying the cheque was given on 13.3.2001 post dated 27.4.2006 and produced the same filed suite on me .Firm account closed on 30.3.2002 by the bank due to low balance .Please advice

you havent furnished more facts regarding the case and about the details of company e.g. what sort of company you had but you can always consult a lawyer or meet me personally

you had a good case but no short cuts. You have not mentioned many other related facts like firm was registered or not etc. You can move the court with all these facts for recall but chances are that you will have to face trial.

If you could prove that their is not legal or enforceable liability as on the date of cheque or if you could prove that you were not responsible for the same, then you will be absolved or acquitted.
