cheque bounce

my two cheques given without date to my brother were put without my knowledge into the bank and has now my brother has issued me a legal notice . how should i defend it

This is a matter of evidence and you may have to go through the process of litigation which would be filed by your brother.

You may defend only if you can establish that you did not owe him any money and that the cheques in question were not issued for "discharge of any liability".

The burden of proof will be upon you as there is a presumption in favour of the payee and against the drawer.

If you owe him money, you may better consider an amicable out of court settlement.
