cheque bouns notice

my advocate issue notice under ipc

138 to my friend but my friend also

reply of the notice he wrote that he

almost give me full money back and

i am cheating him and he also said

that he lodge a complaint with

police.but that facts are totaly false

please tell me what can i do now

and how can i proof it?

You should file case u/s 138 immediately and also file a case u/s 420. He can proof his innocence only by leading documentry proof.

You can prove something by leading oral and documentary evidence.

If you have proofs that amount of cheque is legally due to you, take action in accordance with law.

File a complaint for cheque bouncing in the court. The onus will be on him to prove the facts.

u must file a complain against him within time and also find out whether the F I R was prior to the notice
