A cheque case has been filed and it is pending for more than 4 years, in this case can we file a civil suit to seek remedy

No. The limitation to file a recovery suit u/o 37 cpc is 3 years from the cause of action.

as you have already filed a complaint u/s 138 of NI Act, you may press for cheque amount to be paid as fine along with the punishment to be meted out to accused.
