Cheque Dishonored due to the closed acccount
my friend had taken rs.1 lakh during his house construction and he was to return the amount within one year. he had given a cheque for the surity without mentioning date. when he did not returned the money after one year, i produced the cheque to the bank. I came to know he had closed the account long back. Can i file NIA sec.138 against him

yes,you can file case u/s138 of n.i.act.

yes you can file both civil and criminal proceeding against him.

Yes. you firstly present the cheque in bank and if the same dishonoured then sent a notice within one month from the date of knowledge of dishonour of cheque.Take consultation of a competent lawyer.
