Legal Question in Criminal Law in India

i had given my cheque to a party before two years ,but in a period of time i had given the amount and i didnt get the cheque back but after two years he is black mailing me that he will file a case against me for 5 lakhs.what shall i do

it is a mistake of yours that you did not take the cheque back. is the cheque bearing a date. in case it is 2 years old with date, then your friend only has a remedy to file a civil suit otherwise if it is a cheque without date, he may even file a criminal complaint. do you have any proof of payment of money.
