Legal Question in Criminal Law in India
a cheque for Rs 10 lakh was issued by a lady on Dec 3, 2009 anticipating her future medical expenses if admitted in a corporate hospital. she died on Dec 9, 2009 of sickness in a Govt hospital, treatment was free. she has no husband & children. she has 5 legal heirs (3 brothers & 2 sisters). her brother has withdrawn Rs 10 lakh on Dec 22, 2009 without informing the bank about her death. the death certificate was issued by the Municipal Authorities on Jan 9, 2010. her brother did not inform any of the legal heirs of withdrawal of money. the deceseased lady does not owe her brother any money also. is it criminal offense?

This is a offence under criminal law. The brother knowingly that his sister has been died, withdrew the amount from the bank and with the intention to take undue advantage.
