complaint

in a government auction the higest bidder gave a draft to the authority for the consideration. after some time he gave a request to the authority not to present the draft he promised to give another draft next day, but authority did not consider his request and sent it for collection. it was returned viz signature differs . can the authority complaint against the bidder for cheating and fogery/?

Yes, the bidder was required to deposit a valid instrument.

the property may be resold and this would be the appropriate remedy instead of prosecuting the purchaser because institution of prosecution does not ensure punishment and the person may be exonerated. the only way by which the decree holder can be benefitted is the resale of the property.
