Legal Question in Criminal Law in India
Cpc advice
My brother has been falsely implicated in a case by police. In a land dispute he has been chargesheeted by police for rioting etc, though he was in his govt office at that time. he was implicated by police under influence of the opposite party as opposite party is a practicing lawyer of the city.In the same case eariler four years back police filed chargesheet under section 307 of IPC against the advocate. but so far no hearing has taken place. This has happened due to influence of advocate. Now advocate is trying to pressurise us for compromise . what need to be done? what documents are required before law/court to porve innocence of my brother. What legal remedy we have got to stop interference of practicing advocate?we are facing great problem even in hiring an advocate and getting basic information from court due to advocate's influence.

Re: Cpc advice
You should proceed with the trial and prove alibi of your brother.
In case you are in a position to prove false implication at the instance of local lawyer, you can also take necessary action against him under civil as also criminal law.

Proceed with the Trial.
Re: Cpc advice
Generally, these types of cases go to the SDM of the area as police arrests one under CrPC and not IPC.
If your brother has an alibi, just prove your case before the presiding officer.
