Legal Question in Criminal Law in India
Criminal case has been filed under section 138 , in Mah Pune, for bouncing a 10lakhs check, In court before the magitrate the party has agreed that he is defaulter, GUNA KABUL, know he trying for a compromise, but is not ready to submit, the letter of compromise, on terms and conditions and is trying to extend the dates, by harassing us ,since last one month and 10days above. my lawyers are asking me to file an affidavite, and to procedee with the case, and to send him the summons,
PLEASE CAN YOU SUGGEST WHAT WILL BE THE COST FOR FILEING THE AFFIDAVIT, IN MAHARASHTRA PUNE COURT,? as my next due date is 14thoct 2011, it is very urgent, and then to send him summons. I also want to know if there will be additional legal fees, or terms of my lawyer remain the same when they took up my case.or they will charge me fees seperately.they have suggested to file a civilcase incase this person trying to act nasty.

once you file a civil suit, you need to pay court fee as well and that fee is to be paid to the court being separate from the lawyer s fee.
You should follow advice of your lawyers.
You seems to have confusion over facts. You say at one place that accused has pleaded guilty and thereafter say that summons are to be issued to the accused. Get facts clear.
Lawyers fees are matter between that lawyer and his/her client/s.
