Legal Question in Criminal Law in India
criminal
I am an employee of an autonomous organization under MHRD and an income tax payer.
I took a housing building loan from my organization in the year 1996. Due to unforeseen reason I could not able to complete my house and as such I have never claimed tax rebate under sec 80 cc since 1996.
F -16 certificate has been issued to me by my employer based on the statement of income submitted by me.
It is unfortunate my employer subsequently for two years (only) provided me the rebate
(By inserting the figure in my original statement of income only, though it is not mentioned in my copy) My employer issued F -16. I have submitted the return to IT department.
Latter, I have come to know about the same and submitted the revised return to IT department with penalty.
Can I lodge criminal case against my employer (person responsible for inserting such certificate) for inserting such figure in my statement of Income without my knowledge?

There is no offence made out but your employer can surely take legal action against you.

Facts are incomplete.Filing of criminal complaint depends upon facts.Consult a local lawyer with details.
Re: criminal
No offence made out. Infact, your employer can prosecute you for taking a housing loan and neither utilising it for the purpose nor refunding the same.
