Where the land is agriculture in nature, you may file petition for demarcation and upon the report on demarcation, Collector may remove encroachments, if any.

You may also file civil suit for possession and declaration of ownership.

You may also file criminal complaint at local police station alleging the trespassing on your land after preparing false documents.

Re: criminal law of land grabbing

You have both civil as well as legal remedies available to you under the law. You may a complaint with facts and allegation of false, forged documents and tresspassing into your land on the basis of forged documents to the police station of your area, where the land is situated. If the police refuses to register the complaint (for any reason) you may file a private complaint for investigation of the case under 156(3) Cr P C or a private complaint under 200 Cr P C. For your information under 156 (3) police will do the investigation and report to the court whereas in 200, you will first lead the evidence before the court of your ownership and there false documents and that they have occupied the land in 132. Another remedy is to file a complaint with SDM of your area under 145 Cr P C. Third is to file a civil case for possession.

Vishwa
