Legal Question in Criminal Law in India

Criminal Procedure

my sister suicided by hanging herself and left one suicidal note, which was recovered from her deadbody by the Police Officer in presence of witnesses. a case was registered under section 498A and 306 IPC. The Hon'ble Judge/Session Court acquitted the accused persons. This is a STATE Case.

the question is whether I, the FIR maker, elder brother of the deceased can made an appeal to High Court or State will make the appeal.

What is the lime limit for this appeal?

whether i can make an appeal for revision of judgment given by Hon'ble Session Judge?

Re: Criminal Procedure

You need to seek leave of the court.

Time limit is 60 days.

You may file Revision also. However, scope in Revision is limited.

Re: Criminal Procedure

I am sorry to know your loss. The incident is very unfortunate.

You should file a Revision Petition in the High Court challenging the judgement of the trial court.

You may also pursue the State Government for filing APPEAL AGAINST ACQUITTAL.
