Legal Question in Criminal Law in India
Dear sir,
I am issued 2 cheque .those are bounsd by bank concatvity/searver misttak so both cheque payment done by RTGS&D.D.
but second party charge to him under sec138&420ipc. plz send adivies what i can do it in this matter?

in case the bank is at fault, you may file a separate case against the bank. this will also be a defence in 138 case.

Despite payment of amounts of cheque, if a payee chooses to file a prosecution on the basis of those cheques, then you need to chalk out a line of action in consultation with your lawyer in know of all facts, details, information and documents.
