Legal Question in Criminal Law in India

dear sir,

i was a bank manager, and i was removed from service for unauthorised absence(resigned but not accepted and i was removed, resigned in 2003 october) in 2005 september after conducting inquiry for unauthorised absence, now can bank go for filing a case against me in CBI, for any loans which went bad for any reason? kindly help me by giving advice.

You have not mentioned reasons for your long & unauthorised absence form duty inviting stringent measure of Disc. action anf removal from service by the Bank. Anyway I presume it has nothing to do with your fear of any loan becoming potentially non recoverable. Please note that failure of borrower to repay the loans sanctioned/processed during your tenure does not ipsofacto invite any investigation/enquiry against you by Police or CBI. If there is a vigilance angle involved leading to any malfide involvement on your part, that may invite criminal action/investigation by outside agency. If the allegation is that you had given loans unauthorizedly or to favour the loanees, you may be held guilty of cheating and / or misappropriation. The bank may be right in referring the matter to C.B.I. You may need to defend your case through a lawyer.
