Legal Question in Criminal Law in India

Dear Sir/Madam

A land property case was running in court regarding partition of property. During the trial of case, without my knowledge,they have sold and Registered the property to other party?. After registration of property, they have withdrawn the case from the court by showing forged evidence/signatures that we have compromised and shares were given to all eligible property holders?. They forged and submitted to court as genuine.Then they have withdrawn the case from the court.

Later, we came to know the situation and filed a case in court? signature is sent for forensic lab, now forensic reports came to the concerned court. They are not yet opened because of officer is retired recently, appointment of new officer will take time.

Question is, once it is proved that signature is forged,

What will be the action on my share of property by court?

what should be the punishment for the above things to the forged person?.

What will be the action/punishment to the concerned for submission of false evidence to the court as a genuine evidence?

If a proceeding is terminated by fraud or forgery, then all the orders obtained by such fraud or forgery would be quashed or set aside.

In addition, court can also initiate action against person appearing guilt of such fraud or forgery by resorting to provisions of section 340 of the Code of Criminal Procedure.
