Legal Question in Criminal Law in India
dear sir/mam,
in feb 11, court pass order of maintances 3k per month to me, that was paying by me regularly.
as she is not intrested to stay with me, can i apply for divorce, if yes from where, as she file maintances case from other state were we both not lived and married.... should i apply from that state, as that state is my current residential.
and can she use 498a aganist me as we are seprated from last 2.6 yrs. and also out of 5 yrs marriage she live max. 8-9 months with me in intervals.....can this reason is valid for divorce...
plz. suggest me a better option we have one child of 4 yrs..

You may file divorce petition at the same place where she has filed her maintenance case. The chances of 498A FIR are looks bleak. You should continue making payment of maintenance amount regularly and should also look after the child.
you may hire a local good advocate and check chances for divorce by mutual consent.
