Legal Question in Criminal Law in India
Dear Sirs,
My question is my 2 cheques got bounced for which i registered a case in Thane court in 2004 since nothing happened and kept getting dates i lost track of the case. The amount is Rs.10lacs (5lacs each cheque). Now is it possible to reopen the case as the originals are still in the court. Please advise>
thanking you.
Best regards,
Capse.

You have not mentioned latest position of the case. It may be better for you to inspect the court records and apprise me of latest situation so that appropriate advice may be given. You may provide me all details by e-mail.
you may file an application for reopening the case which i presumed is dismissed due to default in prosecuting the same. but i dont see good chance of getting the same restored. it is advisable to file a civil case u/o 37 of civil procedure code on the basis of those cheques in case the cheques are not more than three years old.
