Legal Question in Criminal Law in India

Over a decade ago I was a defendant in an automobile accident in Haryana, India. The other person in the accident fractured his leg. The case did not get anywhere, the person hurt never attended the proceedings and a couple of years into the case I left for the US and have been living here since then. I have not travelled to India for a long time.

I am told, though I am sure about this, that I have been declared a proclaimed offender. I checked the Haryana police web site and did not find my name listed amongst the list of Proclaimed offenders.

I want to find out if there is still a case pending against me? is there a warrant outstanding.

What is the best way to get this information and if needed can this be resolved without my presence in India.

Of-course I am willing to hire a lawyer experienced in these matters.

Thank you

yes, its advisable to hire a lawyer in haryana or delhi to ascertain the stage of your case. even if you declared a PO, proper legal remedy can be availed for cancellation/revocation of the order by the concerned CJM or High Court.

It would be good for you to engage a good and vociferous lawyer ,who would represent you in your absence . Do not come back to India without getting your name cleared in this criminal matter.

You may be aware that even information of matters in lower courts are available online. Try searching on website of District Courts of Haryana.

Else, you may engage a lawyer practicing in the court where your matter was pending and instruct him/her to find out details of the case.
