Delay in F.I.R.
I m owner of 2 bikes due to this my accused neighbor request me for one of the bike 4 use that believing the accused I handed over the bike with all relevant documents. After some time I asked the accused to return the bike but accused gave false assurance that engine has brake down needs mechanical fix up n said I give u after mechanical fix up that by giving lame excuses he fooled me n through a common friend I know that accused approached RTO for transfer of bike in his own name. I went to accused asked for my byk but accused thereatened me that dont call police otherwise I kill u.But I went to police and taken complaint but police took no action.After 1 month 7 day,s he gave cross written complaint against me that he purchased byk from me and I Sined sell latter in presence of 1 wittness. But in statement of u/s 161 cr,p,c accused said that I Sined sell latter in presence of 2 wittness which were record before registration of F.I.R. actually signature were forged by accused.I filed 156(3) in court accused also fileed 156 (3) complaint against me in court .but 10 dates was given court sayig me 4 compromise case is pending trial in court .I want F.IR order.Without withdrawing the present case Can I go high court u/s 482 cr,p,c

I would advise you to file a case u/s 482 cr.p.c in HC.

Yes, you may approach the High Court u/s 482 Cr. P. C. for appropriate directions.

in case the signatures are forged, u may ask the court to register an f.i.r and the IO to send the sale letter to forensic laboratory.
