Legal Question in Criminal Law in India
I was director in a private limited company four years ago, two directors were authorised to sign cheques, we had issued a cheque to our vendor, the cheque is dishonoured he had claimed under 138, after 6 months i was retired from the firm with concent of all other directors, even then I have to go to court to attend that case, whether my retirement from the firm allows me legally to came out from that 138 case.

Were you the Director at the time of issuing the cheque ? Please clarify.

You need to see the date of cheque and date of its dishonour. If at that time you were director, then you will be required to face the case.
