Legal Question in Criminal Law in India
a district consumer forum has given verdict in our favour, asking the concerned co-op society "charged with deficiency of service" to register in the two names of the nominees registered and admitted by the society as per the nomination recorded by the deceased member (died in 1974) of the soceity, who delayed the transfer of plot & shares to the nominees to the tune of almost two decades, in the meanwhile myself and my sister (nominees) have undergone a lot of mental and financial hardships which in other words has ruined our lives as on account of non transfer of the property we both could not construct house anywhere,
thereby we could not generate rental income from the house that could have been built, one nominee lost her husband the other is retired, both cant raise a loan from the banks for want of title deeds to create equitable mortgage on account of this we could not send our children abroad for higher studies.
their lives are shattered & depressed on account of the society's inaction.
anyone will be surprised to know that the society just not bothered to reply to several letters & applications for transfer of shares and plot for almost over 15 years of our representations. our transfer application was never presente befor the managing comitte. whereas our opponents leetter were very proptly responded and an illegal attempt to transfer the shares and plot to one person who happens to be a witness to the nomination document executed by my father.
under the circumstances please advice which & what action will be most effective & appropriate, And please let us know if action (Legal) should be initiated against the office bearers of the society by naming a few individuals who were deliberately delaying at the behest of our opponents or in general, Can we claim compensation and damages, if so how much will be o.k., can we also book him under Human Rights Violation and also defamation laws & criminal laws as they have accused us of forgery, manipulation, fabrication, etc,without producing any evidence, please advice quoting a few of the citations relevant to the subjects, thank you sirs. y naidu

You can certainly claim compensation for the inordinate delay.
