Legal Question in Criminal Law in India
I do not want divorce from my husband and I want to stay with him, but at the same time he and in-laws should be punished from the court. Is that possible and please provide me the complete details. Is 498 is of such kind. If I file for 498 is it the ground for divorce or for punishment?

498a is a criminal case and divorce is a civil remedy.

you can't get both at the same time. 498a is for cruelty/harassment for dowry. cruelty is a ground for divorce. regarding nature of 498a and divorce i agree with Adv Gupta.

You cant have both things together . If you file a complaint u/s 498a , the chances of divorce becomes high as your husband would not like to be humiliated by you with your allegations.
