emotional harrasment and adultery by spouse

i have undergone a lot of emotional harassment by my hubby also he has committed adultery by already having a relationship with another female even before marriage and keepin me in the dark. i have now moved to my home - away from my matrimonial place an i want to file an FIR under section 498A. Can someone help me with the procedure and let me know if i can file it from my native place, which is other than the place where the crime has been committed

A criminal complaint can be filed at any place where offence or part of offence is committed.

You can file the police complaint at any place. However, we suggest you to take help of a local lawyer who would guide you throught the procedure.

A criminal complaint u/s 498-a can be filed either a place where the offence has been committed or where your marriage has been solemnized

You may send your complaint in writing, by registered post, to the SHO and the SP of the concerned area where the crime was committed.

You may also file a case for maintenance from the place (a) where the marriage was ceremonised; or (b) where you lived together last as husband and wife; OR (c) where he is living.
