False complaint under SC/ST Act
I've been flasely accused in a complaint filed under IPC341, 506 & SC/ST Act 3(x). The complainant made the complaint after almost 1.5months after the incidence & police arrested me after almost 2months of writing the FIR.
Actually due to one of my earlier complaint in context with the same complainant, some other police officials got suspended in that case for their misconduct. As soon as an enquiry started against the errant police officials by vigilance deptt., the ACP in-charge of this subject case took congizance after almost 2months. The complainant seem to have connection with the police. The ACP did not served any notice under CrPC 160 and neither did he obeyed the new amendment in CrPC for the procedure of arrest. I've no criminal background and I've been falsely trapped by these people in vengance.
I got bailed out the very next day after arrest & the chargesheet is yet to be filed. But I feel defamed as the arrest took place in evening at 5:30pm purposfully.
Please suggest how can I proceed to quash this FIR?

You've to petition the High Court for quashing of the FIR.

File an application u/s 482 before the High Court.

You may engage a local counsel for approaching the State High Court u/s 482 of Cr. P. C. to seek quashing of FIR.
