Legal Question in Criminal Law in India
I want to file an application before Magistrate under section 340 Crpc which is going on against me. The petitioner has also filed Writ Petition in High Court regarding the cheques. Can I still file Application under section 340 Crpc before Magistrate Court? Also can I also mention in the said application that signature on cheque too is false? Please advice

application under section 340 cr pc is to be filed only before the court where the perjury is alleged to have been caused irrespective of other cases. if perjury has been caued before the magistrate, file the application there only
Since you should be having a lawyer already, try to avoid contradictions and confusions by seeking advices from other Forums.
you need to make out a case for perjury and without understanding all the facts of the case, it is unsafe to decide you in affirmative.
