Can I file a cheating case?

Dear Sir/Madam:

3 yrs back I purchased a apartment as a part of 'prelaunch offer' offered by a reputed real estate company in Bangalore. A sale agreement was given to me with a ''buy back clause'' that they will buy my apt back after 3 yrs at a certain price. Now the company is not honoring my agreement. They are saying that they don't have money BUT lot of land is there on company's name. They have money BUT they don't want to pay me. What should I do? I have been following up with them almost every day & they are ignoring me. Please help me with your valuable advice on what I should to do to get my money back. Can I file a cheating case on the company? Will you be able to assist me? How can I make the company pay my amount back?

(a) You may file a criminal complaint of cheating with the local police;

(b) You may also file a complaint with the local consumer forum for recovery of your money.

(c) If it is company incorporated under Companies Act, you may seek its winding up for failure to discharge 'admitted liability'.

however, you remedies will depend upon the documents available with you. It may be better to engage a local lawyer.

Yes, you can file a cheating case against the company. Other option is you can file a suit for specific performance in the competent court in Bangalore.
