Legal Question in Criminal Law in India

I am going to file an FIR against my elder brother for cruelly attacking my mother and possessed the property. Then I would file a civil case against him to get the STAY order.

1. How soon the STAY order would be given by the court from the time of filing the civil case

2. What is the procedure to get the anticipatory bail. Do I need to pay any cash deposit at court. Because my brother could raise a false FIR and arrest steps using his influence.

it depends what all cases that are to be filed. some criminal offences are bailable and some are non bailable. regarding the stay, you have show that there is a prima facie case in your favour.
