File fir-ques 2

I registered a case of DVA.Hearing is on 1/9/09. I am forced to live with my parents as my hubby and in-laws want to get rid of me. My hubby filed a divorce case and proceeding is on. I have now also filed a case with women cell and am requesting them to lodge an FIR against them. ALL my valuables, istridhan, furniture, clothes are at my in-laws. I do not want a divorce and also want to recover my items. My husband came this time and refused to return the items except for my clothes. The discussion happened in front of ACP also. I want all my stuff bk but he says he will give that in court only and has agreed to give bk clothes. Next hearing in women cell is on 17/07/09. I have been requesting Women cell to file FIR against them but they are not doing so. How can I recover all my item..pls help I want justice and want FIR to be lodged against these culprits.

If you find that police is not helping you, you may consider filing a criminal case in the local CJM court and pursue your remedies.

it is ridiculous that you date of hearing in domestic violence case is 1st of september. as per the law, the complaint under domestic violence act needs to be disposed off within 60 days since the day it is filed. you may ask your lawyer to appraise the judge of the law and get the desired reliefs as soon as possible. DV is the best remedy in your case as you can club all the reliefs and get them faster.

You can file a private complaint under the law.

In DVA application, you will get everything. If you want to register the case then can file a private complaint directly in the court.
