Legal Question in Criminal Law in India
We have filed criminal complaint u/s. 138 of Negotiable Instrument Act. During pendancy of the complaint accused paid part of the amount of the cheque. Please clearify that whether it affects on the criminal complaint.?

unless the entire amount is paid, the complaint cannot be dismissed.

As per AIR 2010 SC 1907 the accused may pay the amount during the pendency of the case along with 10% towards legal aid and the complaint can be finished
