Filing criminal case

I need to file a Criminal case in India.

What steps are need to take? Can I

assign a power of attorney to my

lawyer in India to file the suit? Is

criminal case require my personal

attendance for the filing and

hearings? At what point would my

physical presence be required in a

criminal case?

you can file a criminal case by constituting a power of attorney. what sort of criminal case you intend to lodge and your court presence would depend upon the nature and gravity of offence. even if you ll have to appear, you ll be appearing once for your evidence. do send in the details of your case.

There are various aspects in your case. But there are various ways thorugh which you dont need to come to India but only your counsel wil handle the case. but plz explain your detail of case to guide you thoroughly.

In India, the presence of complainant may be required in a Criminal Complaint on every date of hearing.

Filing can be done through the POA. However, the requirement of your presence will depend on the nature of your case. Ordinarily, it will be at the time of evidence.
