Fir against husband

hI,

I have been living with my parents for the last 1.2 years as my hubby and in-laws refused to take me bk. I have filed a DVA case today and have also approached the WOMEN cell to file an FIR against these people. I have also filed 498A and 406 againts them as all my clothes and jewellery, furniture is with them. I had earler closed the WOMEN CELL case temporarily as my hubby was very irrate that I approached WOMEN CELL. They have filed a case of divorce against me and the divorce proceedings are on,. I am earning 33k per month and my husband is earning abt 80k. Can i get maintenance and shelter. If they refuse to take me can they be arrested. Please answer all questions it's urgent. Women cell people have told me that they will call my hubby and try to settle if he does not agree then an FIR can be lodged. I am married for 3 years and do not hv a child as my mom-in-law would create nasty scenes if m hubby wud co-habit with me..can i get her arrested.Can i re-unite with my hubby please do answer all questions?

Your re-union may largely depend upon your husband. However, you may have a good case for prosecution of your husband and in-laws.

1. Getting maintenance difficult. You can claim restitution of conjugal rights for moving back to your matrimonial house.

2. Husband and in-laws can be arrested only if they violate court order in respect of restitution.

3. You have no powers either to cause arrest or prevent arrest. That is duty of police and/or court.

your fir should be registered by police or you can approach to the court of law. You can also file a maintenance and also demand for a shelter in the same house where your husband is residing as per law. There are lots of things what you can done and teach a lesson to your mother-in-law.
