My friend cheated my money

Dear Sir/Madam,

I live in coimbatore and my friend lives in Trichy.

My friend borrowed 5 lakhs from me. He borrowed 3 lakhs through demand draft, which was issued from a coimbatore bank, since I have my bank account at coimbatore. The other 2 lakhs, I went to Trichy and gave it to him in hand, since he needed it urgently for some family emergency.

Its been 2 years now and yesterday when I asked him, he is saying that he has already given it back to me !!

Where should I file the criminal case? At coimbatore ?? (Because the bank is in coimbatore and the DD was issued from this coimbatore bank) ... or should I file the case at Trichy where he lives?

If I file a case in Trichy then I have to travel 500 kms everytime for the enquiry, is it possible for me to file a criminal case at Coimbatore itself since the money went only from coimbatore bank and I got cheated at coimbatore?

Sir, your case has two loci (points) for the offence of cheating. Coimbatore and Trichy. He misrepresented to you at your residence in Coimbatore, and then the moneys were parted with. It was enjoyed in Tricy.

Thus, without the slightest of hesitation, file a case in Coimbatore, and got for his jugular vein.

you can file the case at coimbatore without any problem as you gave him the bank draft of coimbatore bank.

consult lawyer and make the jurisdiction of other 2 lakhs also in coimbatore.

If you are filing a case for recovery of money you can do it from coimbatore court.

You need to first find out and assess what offeneces are committed in the case. Once that is ascertain, you would be able to decide the jurisdiction within which such offences were committed.
