my friend is a govt. employee and issued a chuque for Rs. 50.000/- to chit fund company for security on behalf of the prised bidder, mean while the coted amount liable after issuing the cheque, in two spells the bidder had paid the amount said amount even though chit fund company filed a case under 138 N.A against my friend is there any provision for exemption of punishment

Please go through pleading of the complainant in the case, evidence available with your friend to rebut the allegations of complainant and consult your lawyer to defend the case effectively.

If the case turn out to be a false case, your friend can also take action against the company/persons responsible for filing of a false case under civil as well as criminal law.
