Legal Question in Criminal Law in India
A friend of mine was given a sentence of 1 year under section 138 of instrument code in India (Punjab). Can someone tell me how many months he will have to serve actually?

Departing from earlier practice of counting 24 hrs as 2 days, most of the states now follow 1 day = 1 day. Therefore, your friend will have to serve 1 years, subject to remission, if any, granted by the Govt.

the friend of yours should file an appeal against the order of sentence and seek the stay against sentence.
