Legal Question in Criminal Law in India
if a govt. employee is caught red handed in trap case but there is no motive behind the bribe. his parent department give prosecution sanction. the file concerned is reocovered from the HOD, but sanction is not granted by his competent authority and denied more than twice. In these circumstances what will be legal position of the person from whom the recovery has been made.when there is no motive behind the recovery but prosecution sanction has been given.
