Hello

My husband works in US on h1 visa and he is holding indian passport.Distress warrant has been issued against him by indian court as he is not giving maintenance even after execution.Magistrate has ordered ministry of external affair to execute the distress warrant.Can my Husband be deported from US because of this distress warrant?

he cannot be deported only in a maintenance case but in case the warrants are issued in a domestic violence case, the chances are that he be deported.

It depends upon the bilateral agreemnts between two countries.Since you have already engaged the lawyer please advise him to examine this.

India do not have any treaty with U.S.A. for deportation. However, you may need to vigorously pursue US authorities by supplying them documents against your husband. The US authorities consider it very serious if a man is not meeting his maintenance obligations. The services of a US based Attorney may be required to pursue your case there.
