Legal Question in Criminal Law in India

Hi,

My cousin is living in abroad and his father in law had given a private complaint against him under criminal breach of trust to return the jewels given to his wife who is not alive. Since they are trying to send summon to him abroad so he will get summon abroad anytime.

Can he able to ignore the summon? or If he accepted the summon, Should he need to appear to the court or can he request some additional months time to appear ?or can he appoint some one as power agent for the same to attend the hearing?

or Is there any possibility to quash the case with higher court?

Please advise and send ur recommendation.

He should immediately return the entire "istridhan" and try for an amicable out of court settlement. Failure may lead to very serious consequences including a possible jail term. Avoidance of summons is no solution. There may hardly be any chance of seeking quashing of case from High courts.
