Legal Question in Criminal Law in India
Hi,
My father bought a second hand car for Rs 20,000 from his aquaintance. He didn't transfer the papers in his name due to some circumstances that are unknown to me. He wanted to sell the car after learning Driving Skills. He bought the car for the sole purpose of learning Driving after which we planned to buy a new car. One year later my father passed away. Now I couldn't find the papers of the car anywhere in the house. The car was kept at the house of the person, who used to teach him driving. Since I cannot find the papers, I asked him to make new ones, but he ststed that the car was not transferred in my fathers name. Also his neighbours told me that he has been driving the car for himself after my fathers death, and supposedly it had been involved in an accident. Some of my father's friends are saying that if the car is driven again, I will be involved in a criminal case. So I should forget about the car.
Can anybody tell me what should I do? All I have is a photocopy of my fathers learners license which just contains a picture of the Car No.
Is there any way I can make new papers this time in my fathers name? Is there anyway of checking whether an FIR is really registered in the cars name, since it was involved in an accident? Your help is really appreciated.
