Legal Question in Criminal Law in India

I have been implicated in a false case U/s 306IPC read with IPC 34. Trial was started already in 2010. FIR registered in 2008 August. Can I go for Appeal in High Court for quashing the FIR now. Pls give adivise.

Yes, you may file for quashing of FIR. But, for it, you must have good grounds or in as much as the whole of charge sheet, on its face value taken as true, does not have any evidence against the person intend to go for quashing. Since the matter is at the stage of evidence, the court may not even interfere for wanting to let the evidence be completed.

If you think that you have a good case for quashing then go for it. Quashing can only be done in High Court.
