Legal Question in Criminal Law in India
If an Indian H1B from the US has absconded to India after having charged with sexual offense on a minor (16yr), can he be extradited to the US? Can he fight against his extradition?

Depends on terms of the Treaty of Extradition in the context of nature of the offence.

Yes . If anyone has committed any crime in USA whether he or she is on a Non -immigrant visa to USA or has a Green card or is a citizen runs away to India will be extradited as there is a Extradition Treaty between both the countries. Yes he will be given a chance to contest the extradition.
