Legal Question in Criminal Law in India

In a Right to Information matter and on request of the Head of a Government Department a Retired Government employee has furnished a false information without verifying all records.

In this case a part of record was only verified. The Retd Govt. Employee is well aware that it is part of record only and not complete record as he has served a maximum term of service in that dept.

When the same matter regarding the information supplied under RTI act was challenged in a Civil Suit. That Government Dept Head failed to file a Affidavit stating that the information given under RTI relates to complete record.

Now can both the Retired Government Employee and the Higher official can be charged under perjury ?

Prima facie appears to be a case of perjury.

However, you need to be guided by your lawyer having studied all the papers and conversant with all the facts and circumstances.
