I purchased a car from dealer. Sell latter is not signed in my presence. Dealer alleged in our FIR against me that - by forge ring the signature on sale letter he went to RTO and tried to get transfer the car ownership in his own name by preparing forge documents but could not succeed due to miss match signatures in transport authority. I want to lodge cross FIR against dealer for selling me car on the basis of forge papers. Is this possible that in same cause of action (forge signature) FIR lodged from both side? Is in provision of law? Sub inspector told me that in same cause of action FIR from both side is not possible

Yes he is correct. The mischeif has to investigated inthe same crime by police, then file the charge sheet or final report. If you want you can file seperate petition at PS or in court stating the cheating of dealer.

Your statement is not complete. Earlier you wrote about having made a payment of Rs.50,000/-. You have not disclosed the method of payment; and the witness, if any, to the payment made for the car.

You are missing an important link in the chain - payment of Rs.50,000/- you wrote earlier you made at the time when you got the delivery of car and the papers. Therefore, your cause of action has arisen from the cheating arising of payment received by the person against forged documents.

If you have proof of payment in writing, then you have right to lodge counter FIR. Version of Police is incorrect avoiding responsibility.
