Legal Question in Criminal Law in India
interim has been passed against husband. high court has dismissed the criminal revision petition. Can we get stay on interim order for maintenance and recovery againsy husband.
grounds:
1- lady's bad character.
2-children are majot and living with father.
3- children has made clear allegation against their mother, of having bad character and relation to other males in affidavits in support of reply given by husband
4- Sec.13 HMA pending filed by husband.
5- lady left husband 5 years age. she ran away with another person. we made legal proceedings, in which search warrents were issued against the lady and the person with she ran away. After 2 years of filing sec13 of HMA lady came u/s 12 dv act .
6- husband is govt. employee.
